Работы посвящена рассмотрению принципа res judicata в российской доктрине процессуального права, а также призвана ответить на вопрос о том, соответствует ли современных подход российского законодателя принципу res judicata. Целью настоящего исследования является общетеоретическая разработка категории res judicata для её понимания российским правоприменителем, выработка понимания последствии res judicata, выявление характера res judicata в качестве принципа процесса и в качестве свойства судебных решений. Помимо указанного авторы также полагают необходимым установления взаимосвязи res judicata и преюдиции в континентальной системе права, влияния res judicata на преюдициальность судебных актов и установление границ разрешенности дела для целей его пересмотра.
