Alternative Claims and Their Analogues in the Civil Procedure.

The study is devoted to the research of theoretical and practical problems of individualization of the claim in the civil and arbitration proceedings of the Russian Federation. The paper reviews with issues related to the value of the subjective interest of the claimant in choosing a certain way of protecting the violated right to individualize the claim in Russian procedural law. A study was conducted on the individualization of the claim in foreign law and order - in countries of common and continental law. This paper reflects the results of the author's comparative legal analysis of the current procedural rules for individualizing the claim in foreign countries. Moreover, foreign models of alternative claim have been examined and analyzed. The doctrinal approaches of Russian lawyer to the possibility of presenting alternative claim in the Russian Federation have been studied. Proposals have been worked out to improve Russian civil and arbitration procedural legislation.
