Joint Ownership of the Exclusive Right

In this paper, the problems of the regime of joint ownership of exclusive rights, in particular, the division of exclusive rights, the application of certain provisions of common property to the relations of joint ownership, as well as the individual contractual and corporate models of structuring relations of joint owners, the risks of charge on intellectual assets of joint owners. In addition, the author analyzed the foreign experience of regulation of joint ownership of exclusive rights. On the examples from the Russian legislation and judicial practice the problems of use and disposal by joint owners of exclusive rights to certain intellectual property objects, in particular, trademarks, patents, the secret of production are considered in detail, the exceptions to the regime of joint ownership are considered.
