Adversarial and Dispositive Principles in the Civil Proceedings of the Russian Federation

The current research is devoted to the problems of realization of adversarial and dispositive principles as essential, fundamental and substantially interrelated principles in the civil proceedings of the Russian Federation. These problems are illustrated with provisions of Civil Procedural Act of the Russian Federation and the court practice. The goal of the research is to investigate the essence of adversarial and dispositive fundamental grounds in the civil proceedings of the Russian Federation and reveal the problems of practical realization of these principles in several procedural institutes of the civil proceedings of the Russian Federation. Analysis of historical background and development of adversarial and dispositive principles in civil procedural litigation and doctrinal positions, the essence, content and limitations of action of adversarial and dispositive principles in the civil proceedings of the Russian Federation and the court’s role in their realization in the civil proceedings is presented in the current diploma.
