Crime in The Cyberspace: Issues of Qualification

Crimes in cyberspace have not been properly criminally qualified, even in developed countries. First, there is no precise definition of "cybercrime", which leads to a lack of an accurate understanding of the phenomenon. Secondly, there are problems of qualification of crimes in cyberspace. The question of attributing a violation of rights outside the real world to a particular group of crimes remains open, it is not clear how the perpetrator should be punished and what sanctions would be most appropriate. The purpose of diploma is a comprehensive analysis of the problems of determining the order and rules of qualification of crimes committed in cyberspace, based on legislative and law enforcement practices in the Russian Federation and abroad. To achieve that goal, the following tasks were set: 1) define the concept of "cybercrime"; 2) specify the criminalized types of cybercrime under Russian and foreign legislations; 3) analyze the legislative regulation of combating cybercrime, and how the criminal law operates in the space; 4) identify problems in the field of criminal regulation of contributing crime in cyberspace; 5) propose possible solutions to the problem of the criminal law lack in that field. According to those thesis and goals, the diploma work consists of introduction, chapters and paragraphs, conclusion. The goal and objectives determined the conclusions of this research work.
