Peculiarities of Collective Management of Intellectual Property Rights

Collective management of copyright and related rights is a mechanism whose goal is to optimize relationships between authors and other rightsholders and users. Due to the specific nature of the objects of intellectual rights, which do not allow to control the usage of such objects, the implementation of individual management in the context of the widespread of the Internet, seems to be ineffective. Legal regulation of collective management organizations has a number of significant shortcomings, which leads to the non-transparency of their activity, as well as to misuse. The diploma thesis is dedicated to the designation of a number of essential characteristics of the mechanism of collective management, and the identification of problems related to its functioning. The structure of the study is built around the very concept of collective management, its main subjects and objects to which it is directed. In addition, the work identifies features of the creation and functioning of collective management organizations. the important part of the work became a question about the possible replacement of existing collective management organizations by the systems based on blockchain technology.
