Parties to a Commercial Concession Agreement

This work is devoted to the analysis of the contract of commercial concession, in particular the subject composition of this contractual form. The purpose of the work is to determine the composition of the parties on the legal relations of Chapter 54 of the Civil Code of the Russian Federation, to draw up a comparative legal analysis of the subject composition of the domestic model with the foreign franchise model. To achieve this goal, the following tasks were set: 1. Search and processing of doctrinal sources related to the topic of work in order to obtain the necessary picture about the specified type of relationship. 2. The study of the foreign model of franchising, the drafting of a brief description of the contractual relationship in this area - studied domestic legal and foreign literature, as well as directly regulatory legal acts to be applied. The results of the work are: 1. General characteristics of the contractual relations of Chapter 54 of the Civil Code of the Russian Federation. 2. The solution of the issues of correlation of the two contractual models, in particular through the prism of the parties to the contract. 3. Determination of the subject composition of the two contractual models - the main points of contact and differences are defined. 4. The problem of introducing NPOs into the subject composition of a commercial concession agreement has been raised, with the aim of further analyzing this issue in future works.
