Inheritance of intellectual rights according to Russian law

This work is devoted to the issues of inheritance of intellectual rights in accordance to the results of intellectual activity and means of individualization. The aim of the work is to identify the specifics of the rules on the inheritance of intellectual property rights, to clarify the legal essence of such inheritance. The relevance of this topic is predetermined by the variety of intellectual rights, as well as sometimes contradictory and unsystematic legislative provisions affecting this issue. Despite the abundance of doctrinal positions on the inheritance of such rights, as well as explanations from the higher courts, many problematic aspects remain unresolved. In this paper the main issues related to the inheritance of exclusive rights, the fate of personal non-property rights in the context of inheritance are developed, and also a brief overview of the historical development of the institution of inheritance of intellectual rights in Russia and abroad is given. Based on the analysis, a number of shortcomings in the legal regulation of this area were identified.
