Legal Regulation of the Agreement on Public-Private Partnership in the Russian Federation

The paper is devoted to the study of the problems of legal regulation of the agreement on PPP. This contractual form exercising PPP enables the state to achieve infrastructure objectives profitably to ensure adequate living conditions and development of the population. However, as a result of a system analysis of the Russian Federation legislation in the field of PPP, as well as some papers on the research topic, it was found that the legal qualification of the agreement on PPP included in Federal Law No.224 does not correspond to reality. Since PPP is a type of investment activity that has various contractual forms stipulated by federal laws, a PPP agreement should be considered as a collective concept that covers various investment agreements related to different branches of law. Therefore, there is a necessity to systematize the investment legislation of the Russian Federation, including determination of PPP as an investment activity, and the agreement on PPP as an investment contract; establishing an approximate list of investment contracts related to the collective concept of “the agreement on PPP”.
