Features of Bringing an Arbitration Manager to Liability

The study deals with the problem of bringing the qualified receiver (arbitration manager) to liability. The purpose of the research is to reveal the factors that determine how the losses are proved in the arbitration process, how the guilt is proved in administrative process and how the disciplinary liability is applied. Methodologically, the research is conducted within the framework of civil law, administrative law and bankruptcy law of the Russian Federation, which helps to establish broad connections between civil and administrative liability in a bankruptcy case. The research is anticipated to result in formulating the most frequent reasons for bringing the arbitration manager to civil, administrative and disciplinary liability. The results are intended to be easily adopted for amending existing Federal Law “On insolvency (bankruptcy)” №127-FZ of October 26, 2002, Civil Code of the Russian Federation and the Code of the Russian Federation on Administrative Offenses.
