The Arbitrability of Corporate Disputes

For years the possibility of corporate disputes arbitration has been discussed. The issue was most acute in the Russian Federation since neither the legislation provided the precise answer, nor the state courts had a well-established practice on the issue. In 2015 the Federal Law “On Arbitration in the Russian Federation” and the Federal Law “On Changes to Certain Laws of the Russian Federation” were adopted by the Federal Assembly in the Russian Federation. The amendments to the arbitration legislation stipulate that several types of corporate disputes are arbitrable, but this is still insufficient to establish the risk-free arbitration in the Russian Federation. The paper studies the history of the development of the corporate disputes arbitration and the controversial issues of corporate disputes arbitrability to date, providing critical reflection on the arbitration practice and recommendations on the further legislation improvement.
