The Problem of Delegated Authority

The transfer of authority from one branch of government to another is inevitable within the framework of a dynamically developing democratic state. Thus, by virtue of congestion the legislative authorities are forced to delegate part of their tasks to the executive authorities in order to increase their own efficiency. This approach to the distribution of powers gained popularity in the countries of the Anglo-American legal system. In addition to popularity, it has been well studied by scientists in these countries, both from the theoretical side and from the practical side. In Russia this practice also takes place. However, it has not been studied as thoroughly as foreign colleagues has. That is why the purpose of this work is to examine the practice of transferring powers through the lens of the American experience. The paper demonstrates that the Russian way of transferring authority cannot be considered as delegation in the American sense. However, it can be called delegation with Russian specifics.
