Fraud Associated with Deliberate Non-performance of Contractual Obligations in the Field of Business

The final qualified work on the topic «Fraud involving deliberate non-fulfillment of contractual obligations in the field of entrepreneurial activity» is devoted to the analysis of the provisions of the Criminal Code of the Russian Federation, enshrined in parts 5 - 7 of the article 159 of the Criminal Code of the Russian Federation. Due to the fact that the above norm is a blanket and refers to the provisions of civil law, to understand its content, such institutions of civil law as the institute of entrepreneurial activity, the institute of obligation were considered. The work reveals the appropriate corpus delicti of the crime; it provides an actual judicial practice developing when applying the provisions of the article 159 of the Criminal Code of the Russian Federation. This final qualified work aims to identify the shortcomings of the existing regulation of legal relations protected by the provisions in parts 5 - 7 of the article 159 of the Criminal Code of the Russian Federation, and propose optimal options for improving the legal regulation of the specified segment of legal relations.
