The main idea of the work is to study the institution of inheritance, to consider the main features of the division of hereditary property, to determine the problems of legal regulation in this area and to propose ways to solve them. The author analyzed the theoretical basis, as well as the existing judicial practice in this area, after which conclusions were drawn about what provisions need to be regulated. Detailed research of the order and peculiarities of inheritance division, where a minor, incapable or partially capable citizen acts as a party, has shown that the rights and legitimate interests of such subjects are not always protected. The numerous case law analyzed by the author is the evidence of it. Based on the author's work, the main conclusions were drawn, which are reflected in this paper.
