The Legal Regime of Big Data in the Russian Federation

The purpose of this study is determination of the legal regulation of Big Data in the Russian Federation, as well as forming both theoretical recommendations for establishing of the Big Data legal nature and practical proposals for improving the legal framework of the new phenomenon. Author gives a definition of the term “Big Data”, highlights the characteristic features of the new object, on the basis of which the essence of Big Data is determined. Special attention is paid to various models of legal regulation of Big Data from the point of view of both legislation and doctrine: the possibility of extending the provisions of current legislation as well as approaches to creating a special Big Data regulation is analyzed, after which the author proposes his own version legal regime of Big Data. The question of the legal qualification of Big Data transfer contract, the issues of collecting and processing such data, as well as international experience in the legal regulation of Big Data are considered. In conclusion, author examines the current attempts of formation of the legal framework for Big Data and provides recommendations for its improvement.
