Legal Aspects of Citizen's Data Processing Regulation During the Automated Decision Making Procedure

The aim of this research is to analyze existing legal regulation in the automated decision-making sphere, to identify problems and to develop possible theoretical and practical proposals for improving legislation. The correlation between profiling and automated decision-making procedures is shown. The legal grounds for the use of personal data in the context of automated decision-making mechanisms are identified. The basic rights of personal data subjects that are affected by the use of automated algorithms are determined. In conclusion of the research threats to the fundamental rights and freedoms of citizens arising in connection with the use of automated algorithms are revealed and some recommendations for risks minimization are provided.
