Problems of Countervailing Measures Realization While the Storage of Municipal Waste

The paper examines the problem of compensation for the rights of citizens violated during the storage of municipal waste. The author identified a gap in legal regulation and the absence of rules providing for compensation to citizens living in a municipality that places municipal waste on its territory. This work is aimed at a comprehensive study of the existing problem, as well as the development of draft amendments to domestic legislation. The study examined domestic and foreign literature, as well as the existing regulatory framework and practice. There was a real need to introduce compensatory mechanisms. This conclusion is based on indicators indicating an increase in protest activity on the basis of problems related to landfills of solid municipal waste. The paper considers and analyzes specific compensatory mechanisms from the point of view of their acceptability in Russian conditions. The final result is a draft of amendments to the Federal law.
