Principle of Non-intervention in the Matters of the State and the Obligation to Protect Human Rights: Correlation and Problems

The final qualification work is a study of the relationship between the principle of non-intervention in the internal affairs of the state and the obligation to protect human rights. This study is aimed at identifying the main problems of this principle and the obligation that arises when simultaneously applying, including in situations where the principle of non-intervention is restricted for the performance of the obligation to protect human rights. Such problems do not allow subjects of international law to fully comply with the principle of non-intervention and the obligation to protect human rights. Practical examples of such application, various approaches to the identified problems are analyzed, as well as the existing way to solve them, namely the concept of "responsibility to protect". The author suggests ways to reform this concept to strengthen it as an effective mechanism for limiting the principle of non-intervention in situations where the obligation to protect human rights is fulfilled. Such reform will allow subjects of international law to follow both the principle and the obligation without violating the norms of international law.
