Bankruptcy of the Hereditary Mass

The article defines the features of the institution of bankruptcy of the hereditary mass, based on its main significance - the separation of the property of the testator and the heirs; the relationship of the principles of inheritance law with the mechanism for recognizing hereditary mass insolvency is analyzed; established a general legal principle by which courts and the legislator should be guided, applying the provisions of Section 223.1 of the Bankruptcy Law; proposed solutions to maintain a balance of interests of all persons whose interests are affected by property bankruptcy procedures, as well as solutions to address gaps made by the legislator in article 22.1 of the Bankruptcy Law.
