Constitutional System in the State of Emergency: Problems with Guarantees

The research explores the main issues with observing human rights, the fundamentals of the constitutional system, during the state of emergency or extraordinary circumstances in Russia. The author of the research starts with examining the concept of a constitutional system and constitutionalism in a democratic state and how it correlates with the state of emergency and extraordinary circumstances, and identifies and compares international and national legal documents concerning the observance of human rights during the said circumstances. The research then analyzes the practical problems arising with the execution of the state of emergency in Russia as well as case law concerning the limitations of human rights in extraordinary circumstances, identifies additional guarantees and instruments that safeguard human rights, and attempts to assess their efficiency.
