Features of the Legal Regulation of the Bankruptcy of the Builder

The graduate qualification work is devoted to the research of problems that exist in the legal regulation of insolvency (bankruptcy) procedure of the organization - developer. The purpose of the study is to form a comprehensive view of the legal regulation of insolvency (bankruptcy) procedure of developers and develop recommendations for improving legislation in this area. Within the limits of a target goal in view of the Law on bankruptcy the concept "builder" is analysed, features of the legal status of participants of building and the requirements shown by them to the builder are established, ways of repayment of requirements of participants of building are considered, new mechanisms applied by Fund of protection of the rights of citizens - participants of share building are studied. As a result of the analysis of the legal norms regulating the relations between the developer - bankrupt and construction participants, recommendations on how to improve legislation in this area were formed.
