Compulsory Medical Measures, Apllied To Persons With Mental Disorder Not Excluding Responsibility

According to the Russian Ministry of Health, about four million people in the country suffer from mental disorders - of a non-psychotic nature, psychoses, states of dementia or mental retardation. Obviously, with a large number of people in need of psychiatric help, it is likely that one of them, due to the morbid state of the psyche or the circumstances, will commit a criminal offense. It is noteworthy that not all persons suffering from a mental disorder commit a crime in a state of insanity: some of them are aware of the unlawfulness of actions or inaction, but cannot be an ordinary participant in the criminal process for medical reasons. To solve this problem, an institute of compulsory medical measures was created in Russia. However, the legislative execution and implementation of these measures in reality, especially for persons with limited liability, casts doubt on the current state of this legal structure.
