Electronic Evidence in Commercial Proceedings

This topic is relevant for research in the framework of the science of arbitration procedural law. Its relevance is due to the global increasing role of information technology in all areas of our lives. Almost all public authorities use electronic document management, public services, business registration, transactions are increasingly carried out online. The rapid development of electronic commerce leads to the fact that during the trial, documents that do not have a material form are increasingly presented as evidence. Despite the presence of many new regulatory legal acts, amendments to existing ones, the participants in the trial when submitting electronic documents in practice still encounter some obstacles due to the existence of unsolved problems. The purpose of the study is to comprehensively study the legal nature of electronic evidence, determine their status, and criteria for their assessment in arbitration proceedings. The study of regulatory legal acts and theoretical foundations, to determine the path of development of e-justice, and solve the problems of proof, as a result of the introduction of new technologies. As a result of the study, the author concludes that it is necessary to establish exact criteria for the admissibility of electronic evidence and the procedure for their evaluation.
