Commercial Secrets in Labour Relations

This research paper is the comprehensive analysis of commercial secrets in the context of labour relations. According to court practice, the most significant risk of unauthorized disclosure of commercial secrets comes from employees. They often intentionally or unintentionally disclose valuable commercial information and, thereby, negatively affect the company's position on the market. Respectively, the purpose of the work is developing a modern legal doctrine, as well as the formation and theoretical justification of proposals for improving labour legislation in terms of regulating the use of commercial secrets in labour relations. The paper provides practical recommendations for improving the level of protection of commercial secrets in the organization; considers the types of legal responsibility of employees for disclosing commercial secrets; considers the main features of regulating trade secrets in labor relations in the United States, China and some European countries; makes proposals to improve the regulation of commercial secrets in labour relations.
