Legal Nature of Persecution (Stalking)

Over the past few years, the problem of violence in all its varieties and forms has become one of the most pressing topics not only in Russia, but also in the world. Usually, society associates the word “violence” with domestic violence of partners, spouses, etc. or sexual harassment. However, unlawful persecution (stalking) also represents a form of violence. In this thesis, we have examined the term ‘’illegal prosecution’’, figured out why the current criminal law is not able to protect the victims of persecution, and what positive experience we could adopt from foreign countries. To achieve this goal, an analysis of the existing legislation in Russia was conducted on the subject of the possibility to prosecute the stalkers today; the main problems associated with the exhaustive regulation of this crime were studied; and legal acts of foreign countries were examined. The main results of the work were the analysis of various points of view on the regulation of ‘’illegal prosecution’’, proposals for the settlement of this crime in Russia
