Court\'s Functions in Сivil, Сommercial and Аdministrative Proceedings

This work is aimed at studying the functions of the court in civil, commercial and administrative processes. The purpose of the study is to establish the significance and a role of the court, its powers in terms of interaction with the parties, depending on the subject matter of the dispute and the form of the process determined by it. In the course of the analysis, three models of relationship between the parties in the case will be developed, which serve as the basis for identifying three forms of implementation of the "civil" process – civil, commercial and administrative proceedings. This paper examines the effectiveness and procedural features of mechanisms for the implementation of functions by the court, depending on the form of the process in which they are carried out. As a result of the research, the General trends inherent in the procedural interaction of the court and the parties in civil, commercial and administrative processes are identified, ways to improve the court's activities in dispute resolution, which, on the one hand, is carried out in conditions of competition and equality of the parties, and on the other hand should be aimed at achieving de facto equality, providing the necessary level of assistance to a "weak" side.
