Recognition of the Marriage Contract Invalid

The master's thesis is devoted to an analysis of the provisions of the Russian law dedicated the recognition of a marriage contract invalid, as also an analysis of main trends in law-enforcement practice. Study purpose is to analyze the marriage contract in the system of contractual structure, to search legal cases and main trends formed by judicial practice, as well as making suggestions to change the currently existing legislation of the institution of the marriage contract. The master's thesis consistently consists of an analysis of the following aspects: 1. The historical genesis of the structure of the marriage contract; 2. Qualification of the legal nature of the marriage contract; 3. Review of general and special grounds for invalidating of marriage contract and relevant judicial cases; 4. Main trends in estimating length of time allowed for filling a claim in in law-enforcement practice for recognition of a marriage contract invalid; 5. Identification of the scope of persons entitled to call on the recognition of the marriage contract invalid. The master's thesis is intended to put emphasis on topical issues arising out of and in any way connected with the law-enforcement of the provisions related to invalidity of the marriage contract. In order to solve them, it is suggested to bring up to date the relevant legislative framework and clarify the most questionable issues by the legal interpretation of the competent authorities, for example by establishing of a list of explanations, the consideration of which would best contribute to the protection and restoration of the violated rights of individuals.
