Legal Protection of Intellectual Property in Sports

The dissertation discusses some aspects of legal protection of intellectual property in sports. The relevance of this work is explained by the development of sport and its active introduction into the economic sphere of life. The following methods were used in the research: dialectical method of scientific knowledge, formal legal, comparative legal, normative, method of interpretation of legal norms and method of system analysis. The purpose of this work was a comprehensive study of the mechanisms of intellectual property protection and proposals for legislative reform. Research objectives: the definition of the concept of intellectual property and its significance in sports; identification and analysis of international sources of intellectual property rights; detailed analysis of patent, copyright and related rights in sports; analysis of protective ways of the intellectual rights; study of judicial practice on the issue under consideration. The structure of the master's thesis is determined by the subject, goals and objectives of the research and consists of an introduction, two chapters, conclusion and bibliography. The first chapter reveals the essence and concept of intellectual property, as well as its significance for sports by analyzing the theoretical works of Russian civil scientists, as well as considering the existing practice of implementing this institute in sports. Further, the international sources of intellectual property regulation in general and in sports in particular were analyzed. The second chapter provides an in-depth study of the protective mechanisms pf certain problematic sub-sectors of intellectual property in sports and an analysis of existing methods of protecting intellectual rights in sports in the Russian federation. The result of the research is proposing of some ideas to reform the civil legislation.
