Protecting the Confidentiality of Information Used in Business Activities

With the development of society, information has become more valuable. Information that takes place in business activities needs to be protected, since it contains such information, the disclosure of which may entail adverse consequences for the entrepreneur. The secrecy regime protects the rights of entrepreneurs and guarantees their profit. The purpose of the study is to identify existing gaps in legislation and in judicial practice related to the use of commercially significant information, and to propose possible solutions to the existing problems. The results show that the existing problems are related to legislative conflicts and the specifics of the legal consciousness of entrepreneurs. To establish an effective mechanism for the protection of commercially significant information, it is proposed to improve legislation in this area (to clarify the rules, bring the statements of laws into line with each other). Also, it is proposed to strengthen the moral and ethical foundations of entrepreneurship in general, to form a respectful attitude to confidential information among business entities.
