Legal Regulation of Bankruptcies Containing Features of Offences and Crimes (Illegal Bankruptcies)

Unstable situations in the economy happen with a regular order, many economic entities, participants in civil turnover become insolvent (bankrupt). However, not all of them are conscientious participants in the legal relationship. Many of them are trying to avoid paying debts to creditors and legal bankruptcy proceedings. So, they commit offences or crimes. In such circumstances, it is very significant to have reliable and elaborate mechanisms to counter illegal bankruptcies. In this paper, we studied approaches to understanding and regulating illegal bankruptcies, examined their various types, considering the peculiarities of the elements of crimes. The mechanism of revealing signs for illegal bankruptcies is investigated, problems and possible solutions are identified. The problems of criminalizing illegal bankruptcies are formulated, as well as the procedure for bringing the persons controlling the debtor to subsidiary liability.
