Legal Regulation of Bankruptcy of Citizens

This research is devoted to the analysis of legal norms and judicial practice on the issue of legal regulation of bankruptcy of citizens, including persons held vicariously liable. The paper defines the concept, features, criteria of bankruptcy of an individual, examines the foreign experience of regulating the bankruptcy of individuals, analyzes the procedures applied by the court to bankrupt citizens in the Russian Federation, defines the concept of subsidiary liability under the law on bankruptcy, examines the legal nature of bankruptcy of persons brought to subsidiary liability, and identifies the consequences of bringing the controlling debtor to subsidiary liability. The relevance of the study due to the rapid development of Institute of bankruptcy of citizens, which is expressed in annual growth of procedures of bankruptcy of citizens, and also to increase the number of judicial practice and scientific literature on the subject.
