Legal Regime of Well-known Trademarks

In the master's thesis on "The legal regime of well-known trademarks," the conditions of the legitimate use of well-known trademarks are investigated. The paper considers the approaches of Russian and foreign doctrine and practice to the definition of the notion of well-known trademarks, their functions and the procedure for recognizing a designation as a well-known trademark. Additionally, the grounds for contesting the protection of well-known trademarks, types of infringement, unfair competition both from the owners of well-known trademarks and from other market participants are examined. Special attention is paid to the types and methods of protecting well-known trademarks. Based on the study, the author identifies a number of legislative gaps in the regulation of well-known trademarks and suggests options for resolving legal conflicts in the framework of the use of well-known trademarks
