Aspects of Exclusive Right Disposal in Business Relations in the Film Industry

The master’s thesis deals with the legal regulation of relationship between participants of the film industry and is aimed at identifying the specifics of exclusive rights disposal in the process of filmmaking. The work consists of introduction, the main part, presented in three chapters, conclusion, bibliography. In the first chapter was examined the doctrinal approach to understanding the civil law institution of exclusive right, analyzed the current legislative regulation, identified the features and content of exclusive right and considered the system of contracts on the disposal of exclusive rights. In the second chapter, the legal regime of a film as a complex object is studied, the features of the legal status of the film's authors (the director, script writer, composer) and producer who is considered as the key subject of film production, were analyzed. The third chapter is devoted to the consideration of contractual structures that mediate the disposal of exclusive rights in the filmmaking process. The legal nature of the contract for the creation of an audiovisual work is determined, the key features of the transfer and granting of the right to use objects included in the film are considered. The final part contains a list of conclusions made by the author during the study.
