Preliminary Legal Effect of a Contract with a Suspensive Condition

This research paper is dedicated to the legal effect of the contract including a suspensive condition before the fulfillment of this condition. The author provides a comparative analysis of the applicable provisions of the German and Russian Civil Codes and civil legislation of the Russian Empire and Soviet Union. In particular, the author considers different kinds of transactions conducted with expectant rights and obligations, remedies available to a party of a conditional contract, and the effect of such a contract after the occurrence of a suspensive condition.
