Exceptional Event in PPP Projects: Legal Nature and Requalification Risks under Russian Law and International Practice

The author conducts research on the institution of Exceptional Event in the field of PPP. The author has analized the texts of PPP agreements and concession agreements concluded on the territory of the Russian Federation. Based on this analysis, the author has classified special circumstances according to the legal consequences associated with their occurrence, and has given each type of Exceptional Events a legal classification. The paper also describes the risks of using the institution of Exceptional Events in PPP projects and examples of international experience in using Exceptional Events in the field of PPP.
