Institute of Unworthy Heirs in Inheritance Law

Student: Monetov Mikhail

Supervisor: Natalia Vladimirovna Rostovtseva

Faculty: Faculty of Law

Educational Programme: Private Law (Bachelor)

Year of Graduation: 2021

The relevance of this topic is due to the lack of research on this issue from the point of view of Russian law, since such an omission leads to consequences for gaps in legislation due to the fact that legislators, both in domestic law and foreign law, take into account doctrinal views on this or that issue in the process of adopting legislative acts. In particular, the relevance of this work is due to the increasing number of conflicts in the application of Article 1117 of the Civil Code of the Russian Federation, for example, whether it is the basis for recognizing a person as unworthy of heirs of behavior that resulted in the testator becoming an alcoholic, i.e. the heir contributed to the development of alcoholism in the testator, or whether it is the basis for recognizing a person as an unworthy heir if he hid from the notary part of the inheritance mass and other similar situations during the application of Article 1117 of the Civil Code of the Russian Federation.
