The research work is devoted to the matters of the legal regulation and practices of the trade secret regime in Russia and some foreign countries. The research work discusses the matters of the history of the development of commercial secrets in Russia and some foreign countries; analyzes Russian and foreign legislation regulating public relations related to the protection of commercial secrets; studies theoretical positions regarding the definition of commercial secrets and measures to protect them as well as proper procedure for proving the fact of disclosure of a commercial secret; identifies measures to introduce a legal regime of commercial secrets and measures to protect them; examines the problems of applying measures to protect commercial secrets; the article analyzes the history and practice of applying non-competition agreements in some foreign countries; studies the practice of applying non-competition agreements in countries with the closest labor law systems to Russia – the Republic of Kazakhstan, the Republic of Belarus; considers controversial issues of applying non-competition agreements in the Russian Federation; considers the prospects for applying non-competition agreements in the Russian Federation; suggests changes in legislation regulating the protection of trade secrets
