International Surrogacy: Problems of Practical Application

In the modern world, the use of assisted reproductive technologies, especially surrogacy, is widespread in various countries. The widespread use of ART is due to the development of scientific and technological progress and the development of new scientific knowledge in the field of biomedicine. The differentiated legal regulation of this institution by States often causes legal conflicts that arise as a result of international surrogacy. Surrogacy is a great way to overcome infertility, a problem that has been around for a long time and is global in nature. Despite the fact that surrogacy is associated with a noble and moral goal – overcoming infertility, this institution is ambiguously evaluated by various societies and states. The legal regulation of international surrogacy is currently at the stage of development and formation, the legislative framework contains a large number of legal gaps and conflicts. The purpose of this study is to identify existing problems in the practice of international surrogacy. As a result of the research, the author proposes to reform the national legislation of the Russian Federation, and also comes to the conclusion that it is necessary to adopt an international act that unifies the legal norms concerning surrogacy.
