Civil Protection of the Business Reputation of Subjects of Entrepreneurial Activity in Russia

In the modern information society, at any time, information may be published that will discredit the business reputation of an entrepreneur. The business reputation of subjects of entrepreneurial activity differs from the business reputation of a citizen by the peculiarities of the legal nature and formation, and as their individualizing image, it is especially urgently in need of adequate protection. The research used the following methods: universal general scientific methods (analysis and synthesis, induction and deduction, analogy). Special legal methods: method of systemic interpretation, legal dogmatic, comparative legal method. It has been proven that compensation for non-material damage is the most optimal way to protect the business reputation of subjects of entrepreneurial activity, which is aimed at balancing non-property loss. In this regard, it is necessary to make compensation for non-pecuniary damage in the list of methods for protecting civil rights listed in Art. 12 of the Civil Code of the Russian Federation. The reasons for the refusal of the courts to satisfy the requirements for the protection of business reputation are revealed. The main reason is the lack of proof of the circumstances and the high standard of proof. An attempt has been made to generalize and systematize judicial practice, which in the future can facilitate the exercise of the right to protect business reputation.
