Self-defense in Business: Theory and Practice

In the work, self-protection of rights is analyzed from the position of referring to the form of protection of rights, which is expressed in measures of factual order. The author proposes a normative definition of self-defense and measures of operational influence on the counterparty, highlights the features of measures of operational influence in business legal relations, and proposes a mechanism for notifying the counterparty about the application of these measures. The article also analyzes the constitutional foundations of the right to self-defense, measures of self-defense of entrepreneurs in civil (non-commercial), administrative and criminal legal relations, studied law enforcement practice regarding self-defense and measures of operational impact.
