Legal Regime of the Results of Intellectual Activity of Employees

The study is devoted to the consideration of the issue of service results of intellectual activity. Currently, a significant part of the results of intellectual activity is created by employees in the course of performing their work duties. The civil law calls such works "service". Finding a balance between the legal protection of the rights to official results of intellectual activity and ensuring the participation of these results in the economic turnover is a necessary tool in the relationship between the employer and the author-employee. The specificity of official works lies in the fact that, unlike the results of intellectual activity created within the framework of a copyright contract or the rights to which were obtained as a result of the conclusion of an agreement on the alienation of exclusive rights or a license agreement, legal regulation is carried out at the junction of civil and labor law. The work contains proposals for improving legislation.

Student theses are objects of copyright and their use is subject to limitations in accordance with the Russian Federation’s law on intellectual property.
