Year of Graduation: 2021

Thanks to the fast development of the world economy, arbitration is becoming the most attractive option for commercial parties to set their disputes while taking part in international trade relations. With the growth of international contractual relations, parties start to invent different varieties of arbitration clauses to manage risks and make sure that the arbitral award will be enforceable. Probably, such type of arbitration clause as asymmetrical one is the most unstable and risky because of the different attempts to interpretate them among jurisdictions. Therefore, in this project we will look into the different approaches and points of view on interpretation of asymmetrical agreements in arbitration. The analysis given in the project will contribute to the establishment of best practice of using asymmetrical clauses which are used to resolve a variety of issues in essential areas of law.
