Self-regulation as a Form of Public Participation: Constitutional Law Aspect

The presented qualifying work is done on the topic "Self-regulation as a form of public participation: constitutional and legal aspect." The work structurally consists of an introduction, three chapters, a conclusion and a bibliography. This work is devoted to a comprehensive study of public participation of self-regulatory organizations in Russia. The first chapter of the qualifying work displays general provisions on the institution of self-regulation and self-regulatory organizations, the information about stages of development of self-regulation in Russia, as well as the concept of public participation in the context of the development of self-regulation in our country. The second chapter is devoted to the status of the institution of self-regulation and self-regulatory organizations in Russia and the problems of definition, including through the analysis of obtaining the status of a self-regulatory organization, the analysis of types of public participation, which includes self-regulatory organizations, the exercise of control powers by the organization, and control and supervision in relation to such legal persons by state bodies. The third chapter is devoted to the study of the powers transferred to self-regulatory organizations by the state, including in the context of the constitutional possibility of such a transfer. In preparing the work, the legislation of the Russian Federation, which regulates the institution of self-regulation, was studied, as well as the works of various scientists specializing in this area. For the purpose of a comprehensive and complete analysis, articles and materials were selected that examine the institution of self-regulation from diametrically opposed sides. Due to the fact that the institution of self-regulation in the final qualifying work is considered from the point of view of the constitutional and legal aspect, the court decisions of the Constitutional Court of the Russian Federation, as well as the existing opinions of the branch Committees of the State Duma of the Federal Assembly of the Russian Federation were studied. To prove certain theses, the work also analyzed information that is publicly available in the information and telecommunications network "Internet", including reports on self-regulation in Russia for the previous two years. The work is set out on 80 sheets, using 103 sources.
