The Procedural Autonomy of the Russian Investigator: Problems in Question

The procedural autonomy of the Russian investigator is constituted of his authorities aimed at the legitimacy of preliminary investigation on criminal cases. This study shows how the investigator exercises his powers and illustrates his dependency on the head of the investigation department and the prosecutor. It is stated that the investigator is entitled to direct the course of an investigation and determine a set of procedural actions that he has to perform to gather evidence and achieve the goals of the criminal procedure stated in Article 6 of the Russian Criminal Procedure Code. What is more, this study contains a short review of the formation and development of the investigator’s procedural status.
