Illegal bankruptcies in the Russian Federation

The research project is devoted to the cases of illegal bankruptcy from the perspective of Russian legislation. In the field of the Russian legal system most scholars define illegal bankruptcy as an economic wrong doing. The study will analyze economic grounds of bankruptcy and thus reveal a number a criteria that would univocally determine the nature of fraudulent bankruptcy. The purpose of the research is to reveal the factors that determine the potential and limitations of declaration of individual/corporate bankruptcy as illegal in terms of Russian legislation. Methodologically, the research is conducted within the framework of Russian civil and economic law, thus comparative, legal methods, as well as analytics and expert evaluation will be used. The research is expected to result in detailed understanding of core principles of illegal bankruptcy that will consistently fit into the understanding of methods the state can use in order to exclude the debtor's possibility to abuse the bankruptcy mechanisms for his personal gain. The results are intended to be easily adopted for educational purposes as a teaching material. The project consists of an introduction, literature review, methods, results, conclusion, and references.
