Labour's Regulation of Sport Judges: Distinctions and Legal Problems

The object of this study is the legal regulation of the Institute of sports referees. The relevance of the research topic is that today sports law is at the stage of formation, in this regard, many issues still remain unexplored. Such issues include the institute of sports referees, the number of works in this area is very small. Of course, the lack of regulation is a reason to study this problem. The subject of the study is national legislation, foreign legislation, as well as the practice of law enforcement. The purpose of the thesis is to study the legal regulation of sports referees, identify problems, identify mechanisms aimed at eliminating gaps in national legislation. Analysis of foreign legislation, as well as judicial practice. Research objectives: 1. Determination of the employment status of a sports judge. 2. Comparative analysis of national and foreign legislation. 3. Determination of the relevance of the codification of legislation in the sports field. 4. Research of national and foreign judicial practice. 5. Development of a draft of a single body for sports refereeing. 6. Review of the project of the Independent Association of Sports Judges of Russia. In the course of the study, both general scientific methods (logical, system, analysis) and legal methods were applied – formal legal, comparative legal, legal modeling method, historical and comparative. Provisions to be defended: * Relevance of the Sports Code, based on the example of foreign legislation; * Codification of sports legislation as an effective regulatory mechanism in Russia; * A codified act as a mechanism regulating labor and legal relations in the field of sports; * The urgency of creating a single body for sports refereeing; * Project Of the Independent Association of Sports Referees Of Russia. The structure of the course work can be divided into several components: the introduction substantiates the relevance of the research topic, identifies the tasks and goals. The first chapter, consisting of three paragraphs, reveals the concept of a sports judge as a subject of sports legal relations. This chapter also raises the question of the relevance of the codification of legislation in the field of sports, both in national law and in the law of other States. The second chapter is devoted to the study of foreign legislation related to the labor law status of a sports judge and the relevance of the project of a single authorized body for resolving issues related to sports refereeing. In the third chapter, the judicial practice related to the issue of the labor-legal status of a sports judge and precedents in sports refereeing is considered. Further, the chapter is devoted to the regulation of the institute of sports judges, through the creation of a single authorized body, and also presents the project of the "Independent Association of Sports Judges of Russia". In the final part, the conclusions about the work done, the positive and negative aspects of the proposed project are formulated. The author's opinion on the current state of labor legislation in the field of sports is presented.
