Judicial Protection of Freedom of Religion in the International Justice System (on the example of the ECHR)

This work is devoted to the study of judgments of the European Court of Human Rights (hereinafter - the ECHR) regarding freedom of religion. The work consists of three chapters. The first chapter reveals the concept, content and limits of freedom of religion. The second chapter is devoted to an overview of the judgments of the ECtHR, which focuses on the topic of wearing religious clothing and displaying religious symbols. The third chapter is entirely devoted to Russian cases in the ECHR, a brief analysis of the selected cases is provided. The aim of the work is to carry out a comprehensive legal analysis of the judgments of the ECHR protecting freedom of religion, in the name of formulating conclusions and recommendations for improving judicial practice. To achieve this goal, the following tasks are set: - to reveal the concept and content of freedom of religion; - to clarify the limits of protection of freedom of religion; - analyze and generalize the practice of the ECHR on freedom of religion and, on the basis of this, develop appropriate approaches. The empirical basis is the materials of specific cases resolved by the ECHR and the Supreme Court of the Russian Federation. In addition, various generalizations of judicial practice were used. Based on the results of the work done, conclusions were formulated, as well as recommendations for improving judicial practice.
