Special Features of the Legal Status of Creditor of a Bankrupt’s Estate (Administrative Expenses Creditors)

In this study, the main issues arising in the application of the institute of administrative expenses in Russia were analyzed. Two grounds have been identified for allocating administrative expenses among the claims of other creditors and granting them a privileged position – economic, which is associated with stimulating participants in civil turnover to continue legal relations with an insolvent person (for the purposes of bankruptcy procedures), as well as essential, related to the very nature of administrative expenses, which, in fact, are the obligations of all other creditors.
