Features of the Processing of Personal Data by State and Municipal Authorities

The right to privacy is one of the most important human rights. In order to protect this right, an institute of personal data was developed and rules for their processing were established. At the same time, the right to privacy cannot be absolute, since sometimes restrictions on this right are necessary to ensure the fundamental interests of society, the state and other citizens. As part of the work, criteria for the admissibility of limiting a person’s right to privacy of his personal life were determined (by analyzing the general principles of processing personal data, rules of international acts and foreign law enforcement practice). The approach chosen by the Russian legislator to determining the balance between the right to privacy of a particular individual and interests of society, the state and individual citizens, as well as law enforcement practice in this area also were determined. Proposals were formulated to improve Russian legislation, as well as change law enforcement practice.
