The Problems of Employee Leasing Regulation in the Russian Federation

The work deals with the problems of employee leasing’s regulation in the Russian Federation. In the first part consistently research the issues of correlation employee leasing and similar legal phenomena, the history and nature of employee leasing as forms of atypical employment. Special attention is paid to the regulation of employee leasing in international law and in the European Union. Also, the author studies the nature of employee leasing relations, which are tripartite. In the second part of the work author critically analyzes the current Russian legislation governing employee leasing and identifies its key problems, such as: the inability leased employee to participate in relations of social partnership and lack of their guarantee of employment. Special attention is paid to the comprehensive evaluation of the employee leasing’s regulation, in which the author sets out the key shortcomings of the regulation of this phenomenon and possible ways of their elimination.
